Terms and privacy

These Terms of Service and this Privacy Policy are one document. Last revised: October 31, 2026. Legal notices and privacy requests: legal@99traits.com. Anything else: contact@99traits.com.

1. Who we are and what this covers

These Terms of Service and this Privacy Policy (together, the "Terms") govern your use of the 99traits website, applications and API (the "Service"). The Service is operated by 99traits ("we", "us"). You accept the Terms when you create an account or submit video. If you do not agree, do not use the Service.

2. Eligibility

You must be 18 or older to use the Service. By using it, you confirm that you are 18 or older and able to enter into these Terms. The Service is not offered to residents of Illinois. Video found to show a person under 18 is deleted when we discover it.

3. The Service

The Service analyzes video and audio of a person, recorded in a guided test or uploaded, and produces measurements ("results") and written reports ("reports"). Each result places the person among a reference group of other people, which changes over time. A report includes only results the video supports. A delivered report is never changed afterwards and records the versions of the method that produced it.

Results describe how a person came across in one video. Reports are provided for information and entertainment. They are not medical, psychological, legal or employment advice, and they do not diagnose or screen for any condition.

4. Your content and consent

On your own account you may submit only video or audio of yourself, knowingly, for yourself. Submitting another person's video is a breach of these Terms and ends your account. Video in which another person takes part, such as an interview or a call, is not measured.

Before an upload is measured, you record a short live clip in your browser. We confirm that the person in the upload is the same person as in the clip. An upload that does not match is deleted without being measured.

Face and voice. When you consent before your first session, you agree that we collect and use scans of face geometry and voiceprints from your video and your clip, to produce your results and to confirm that an upload shows you. We keep and destroy them as section 8 states.

You keep ownership of the video you submit. You grant us a license to host, process and analyze it to operate, maintain and improve the Service, as section 7 describes.

5. Accounts

An account is identified by its email address. You sign in with links sent to that address, or with Google. You are responsible for access to that email account and for activity under your account.

6. Purchases, Practice, Pro, refunds

Free and paid. The test and your profile are free. Its chapters are one purchase, at the price shown at purchase, attached to one session; a new session needs a new purchase, except under Practice.

Practice. Practice is a monthly subscription open to anyone who has bought their chapters. Its first month comes with that purchase. It continues after the first month only if you choose so, at the price shown when you choose, and then renews monthly until you cancel. It covers tests and practice recordings of yourself only, and each test under it comes with its chapters. You may cancel at any time; Practice continues to the end of the period you have paid for, and the profiles you have stay yours.

Pro. Pro is billed monthly. It includes a number of sessions each month and charges each further session at the rates shown at purchase. A session that is rejected, or that fails on our side, is not charged. You may cancel at any time; Pro continues to the end of the period you have paid for.

Refunds. Purchases of chapters may be refunded on request within 30 days of purchase, with no reason needed. A refund closes that session's chapters; its free profile stays. A month of Practice or Pro that has started is not refunded. Gift purchases are final and are not refunded.

Gifts. A purchase may be a gift. The recipient redeems its code, takes their own test, and owns the results; the buyer sees none of them. A gift applies to the recipient's next session and includes its month of Practice. A gift is final: it is not refundable, whether or not its code has been redeemed.

Referral commissions. An affiliate earns 50% of the first payment made by an account that signed up within 60 days of last following the affiliate's link, and 20% of that account's further payments in the 12 months after its first payment, calculated on amounts paid before tax and net of refunds. A commission becomes payable 30 days after its payment; a refund within that time cancels it. Payouts are monthly, once at least $50 is payable from at least 2 different buyers. Purchases by accounts the affiliate owns, controls or pays for earn nothing, and such commissions may be voided before payout. An affiliate may not bid on "99traits" or its misspellings in paid search, use web addresses that resemble ours, or run ads that look like ours. We ask for payout details, including your legal name and tax details, when you request your first payout.

Price changes. Prices and commission rates may change for future purchases, never for completed ones.

7. Privacy: what we collect and how we use it

What we collect

  • Your email address, and your Google account's email if you sign in with Google.
  • The details you give at setup: age range, gender, and whether English is your first language.
  • Video you upload, recordings from guided tests, and the short clip recorded for an upload.
  • How a guided test went (when you paused or finished) and your answers to the statements after it.
  • Results and reports produced from your video.
  • Purchase, commission and payout records. Card details are held by our payment provider.
  • Where you heard about us, if you answer that question, and the links and sites your visits came from.
  • The IP address and browser of each sign-in and of your consent, and records of your visits to the site: the pages you view, what you click, your device and browser, and your approximate location. From your IP address we estimate your country and region.

How we use it

  • Delivery: to produce and deliver your results and reports.
  • Improvement: to improve how we measure, including training our models and building the anonymous reference group results are placed among.
  • Statistics: to produce anonymised, aggregated statistics, including published research.

Improvement is on by default. You can turn it off in your account; the change applies from then on. Anonymised and aggregated data no longer identifies you and is outside that setting.

Selling

We do not sell your personal data.

Service providers

We use providers for hosting, email, payments, and AI models that analyse parts of a recording on our behalf. Agreements limit their use of the data to providing those services.

Cookies

We use cookies and similar technologies for sign-in and to see where visits and referrals come from. We do not respond to browser Do Not Track signals.

8. Retention and deletion

Video, results and reports are kept until you delete them or your account. When you delete your account, we take reasonable steps to delete your personal data: your email address, video, results, reports and share pages. A deletion takes effect in your account at once, and the data is erased from our systems about 30 days later.

Anonymised, aggregated or derived data (statistics, reference distributions, trained models) may persist. Records of visits to the site, including IP addresses, are kept without a time limit and are not deleted with your account. Backups persist until they are cycled. Purchase, commission and payout records, and the record of your consent, are kept for as long as the law requires, under an internal identifier rather than your email address.

Scans of face geometry and voiceprints are used to produce results and to confirm that an upload shows you. They are destroyed with the video or your account when those are erased, and at the latest three years after your last interaction with the Service. Your video, results and reports are not such scans and are kept as described above.

You can delete your account in your account settings. To request a copy of your personal data or to delete it by email, write to legal@99traits.com. We answer verifiable requests within the time the law requires.

9. Sharing

Nothing in your account is visible to anyone else unless you share it. A share link shows only what you chose, and you can turn it off in your account.

If you take a test through a professional's link, you are asked before recording whether to share your profile with them. They see your profile with its chapters, and you can stop sharing at any time.

10. Acceptable use

You may not:

  • submit video of a person who has not agreed to be measured;
  • use the Service to monitor anyone, or to identify people;
  • try to re-identify individuals from published aggregates;
  • probe, scrape or reverse-engineer the Service;
  • use a report or result to make or support a decision about another person's employment, education, credit, insurance or housing;
  • resell results outside what your plan allows.

We may suspend or end access at once for a violation.

11. Pro and API terms

These apply to Pro accounts and to the API. Access is self-serve: creating an API key accepts these Terms without a separate signature. Enterprise agreements are available on request.

You may submit only video of adults who knowingly agreed to be measured, and none of residents of Illinois. Each upload and API request carries a consent reference that points to your own consent record for that person. You will produce that record on request and are solely responsible for the consent. We may audit consent records and suspend access where they fail.

For video you submit through an upload on a Pro account or through the API, we act as your processor. The video is deleted once the results are ready. Results remain available for 30 days, or until you delete them. Such video is not added to the reference group and is not used to train our models.

Usage is monitored, and unusual volume or patterns may lead to review. API access may be suspended without prior notice.

Intended purpose. Pro and the API are intended for the development of the people measured (coaching, practice and career services), research, content, features of your own product for the person measured, and checking whether a video shows a real person. You may not use reports or results to make or support decisions about a person's employment (hiring, screening, promotion, termination, pay, tasks or performance monitoring), education (admission, grading or proctoring), credit, insurance, housing or access to public services, or for law enforcement or immigration, or to infer a person's emotions or sensitive characteristics. The check of whether a video shows a real person may be used to screen for fraud, including in recruiting, provided a person reviews every flag before any decision and the person checked is told that the check is used.

Your responsibility. You are responsible for how you use results and for complying with the laws that apply to that use, including laws on data protection, biometric data, automated decisions, employment and artificial intelligence. Any use outside the intended purpose is a breach of these Terms made on your own responsibility; you will defend and indemnify us against claims arising from it, and we may suspend access at once.

You may use results in your own products. You may not resell results as a competing service, or use results to build or train models that compete with the Service. The API is asynchronous and comes without uptime or latency guarantees. You will defend and indemnify us against claims arising from video you submit or your use of results.

12. Intellectual property

The Service, its models, its method and its report templates are our property. Your reports are yours to keep, export and share for personal, non-commercial use. Commercial use of results by Pro and API customers follows section 11.

13. Disclaimers and liability

The Service is provided "as is" and "as available". Results are estimates and may be wrong. We disclaim all warranties to the fullest extent the law allows.

Where the law allows, our total liability is limited to what you paid us in the twelve months before the claim.

14. Changes, termination, governing law

We may update these Terms. A change applies only to sessions recorded after it takes effect; sessions recorded earlier stay under the Terms in force when they were recorded. We will ask you to accept a material change before your next session. You may delete your account at any time; we may end accounts for violations.

Assignment. We may assign these Terms, with the accounts, data and consent records they cover, to a successor operating the Service, including a company formed for that purpose or a buyer. Your consents, settings and rights carry over unchanged.

Governing law and disputes. These Terms are governed by the laws of the State of Delaware. Disputes go to binding individual arbitration by JAMS under its Streamlined Arbitration Rules and its consumer minimum standards, except small-claims matters and anything the law keeps out of arbitration. You and we each waive jury trial and any class, collective or representative action. The state and federal courts in Delaware have exclusive jurisdiction over matters not subject to arbitration. If any provision is unenforceable, the rest remains in effect.
